Perhaps I'm just insensitive, but if you're not encroaching on someone else's domain, then isn't it alright to use someone elses work as a basis for your own?

That's a genuine question, I"m not sure on the morals of this kind of thing.

Using someone else's art as an inspiration or reference is fine. Blatantly tracing over someone else's art like this is lazy, incredibly disrespectful, and in the case of professional work, potentially even illegal.
